By submitting User Content (projects, images, text, etc.) to Sthala.design, you represent and warrant that you own or have secured all necessary rights and permissions to use and authorize others to use the User Content as contemplated by the Site and our Terms of Service. You retain ownership of your User Content, but grant us a license as described in our Terms of Service.

3. Copyright Infringement Notification (DMCA Notice – or equivalent in your jurisdiction)

Sthala.design complies with the provisions of the Digital Millennium Copyright Act (DMCA) (in the United States) or equivalent copyright laws in other jurisdictions. If you believe that your copyrighted work has been infringed on our Site, please provide us with a written notification containing the following information:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. (Please provide URLs if possible).
  4. Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. This process is for copyright notices only and is designed to make reporting copyright infringement as straightforward as possible while reducing the number of notices that we receive that are fraudulent or difficult to understand or verify.

4. Counter-Notification Procedure

If you believe that material you posted to the Site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us. To be effective, your counter-notification must be a written communication provided to our Designated Copyright Agent that includes substantially the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled. (Please provide URLs if possible).
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.

Upon receipt of a valid counter-notification, we may forward it to the party who submitted the original copyright infringement notification. The original complaining party will then have ten (10) business days to notify us that it has filed legal action seeking a court order to restrain the alleged infringing activity. If we receive such notification, we will not restore the material. If we do not receive such notification, we may reinstate the material in our discretion.

5. Repeat Infringers

Sthala.design reserves the right to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of copyright or other intellectual property rights.

6. Changes to Copyright Policy

We may update this Copyright Policy from time to time. We will post the updated policy on the Site and update the “Last Updated” date. You are advised to review this Copyright Policy periodically for any changes.
